哈特不寫一般理論，寫具體部門法問題筆觸還是相當敏銳的。論文集以刑法中(通常)作為歸責/刑罰必要條件的mens rea為切入點，將法律懲罰拆解為“正當化目的”及“分配正義”兩組問題，分析“功利主義”及“報復主義”兩種理論如何迴應該兩組問題，並提齣一條摺中路綫：在不需要報復主義理論下依然能解釋現行(當時)刑罰中把罪犯的主觀方麵(意圖/預見/自控能力等)作為歸責必要條件的要求--哈特對報復主義的替代方案是“個人自由最大化”，“確定性要求”的(John Gardner稱之為)“法治”論證。但正如Gardner在介紹中指齣，哈特過早宣布瞭報復主義理論的死刑，使他忽視瞭可以將其作為刑罰歸責必要而非充分條件、從而把他的摺中理論糅閤得更好的機會。最後，哈特的文筆簡潔典雅，讀起來真身太暢快瞭～

一如既往地清晰。在Hart看來，犯罪與刑罰是目的不同的兩件事，本文集的理論難題在於刑罰。首先將刑罰的證成區分為普遍正當目的和分配兩個麵嚮，澄清混淆。以此為框架，主張分配麵嚮具有獨立次級價值（secondary value），即刑罰在強製性法律框架之中最大化個體自由，構成對普遍正當目的的限製。進而，重新解釋犯罪意圖理論和以其為基礎的責任理論：犯罪意圖並不隻在報應論中纔有意義，刑事責任也並不依賴於道德責任……越到後麵，Hart需要反復澄清和構建的責任問題越難讀。
