比较传统的马克思主义史学的力作。我觉得所有民法甚至法学专业的人都应该读他，中文翻译非常一般，没校对出的错误也不少，虽没差到无法读的地步。霍爷有力的证明了美国法是如何被重塑以服务与新兴的资本主义，法官通过对私法重塑将成本分配给了社会上沉默的弱势，对动了新型资本主义的发展。

比较传统的马克思主义史学的力作。我觉得所有民法甚至法学专业的人都应该读他，中文翻译非常一般，没校对出的错误也不少，虽没差到无法读的地步。霍爷有力的证明了美国法是如何被重塑以服务与新兴的资本主义，法官通过对私法重塑将成本分配给了社会上沉默的弱势，对动了新型资本主义的发展。

对普通法财产权变迁的分析相当到位

我希望看到像本书这种高质量的美国的专业史，专题史，各个领域的。现在美国通史多，滥，没有意义。

其实读的不是这个版本，但内容没区别就权且这么记录了。一部经典的法律史作品，主要讲两个问题一条主线:一是法律是在不断演变的，二是美国法律的演进是工具主义的，即为了美国的经济发展而服务。所以主线就是经济发展。说说我以为的不足:不是说经济发展作为演进的动力有什么问题，而是觉得这种单一线性关系不足以支撑法律史的进程。本书暗示了从经济发展到法律制定的单向关系以及，暗示了法律的演变始终落后于经济发展的脚步，这可能不是那么太符合历史甚至，可以说是隐含了用先后顺序部分代替因果关系的问题。而最新的制度研究其实也说明了诸如法律这样的制度和经济之间的关系是复杂的，可能更类似福格尔说的协同演化。
